My top 4 tips for achieving successful contract negotiations

When you’re negotiating the terms of a commercial contract, whether that is for a collaboration with a brand, to provide your goods or services, or to establish new partnerships for your business, mastering the art of negotiation will ensure you achieve your goals while protecting what truly matters to you. In this article I will give you my top tips so you can feel more powerful and equipped to enter the negotiation process for your next deal. 

My top 4 tips for successful contract negotiations:

  1. Define Your Goals: Clearly outline your objectives before entering the negotiation process. Whether it's making sure you get paid on time, that your intellectual property is protected, or that your liability is limited, knowing in advance what truly matters to you and what you want to to get out of the contractual relationship is the first step towards success. You can then decide to give up on certain points you are not really concerned about, to show willingness to advance in the contractual relationship, and to focus on negotiating the points that are really important to you. 

    It’s a bit of a “give and take” situation: if you give certain things, you will be able to have more leverage on others. If you make it sound like you are giving away a point that is really important to you, they might even cave in on that clause that you really want to insert in the contract. That brings us to…

  2. Negotiate Responsibly: Approach negotiations with a collaborative mindset. Keep in mind that you are in the process of establishing a commercial relationship with the other party, and that it is in your interest to seek win-win solutions that benefit all parties. Effective communication and a willingness to find common ground can foster positive, long-term relationships. Explain your position when there is a disagreement, provide scenarios to illustrate your arguments and make sure you maintain a positive language that encourages the finding of mutually beneficial solutions.

  3. Understand the Terms: Make sure you thoroughly review and understand the terms of the contract. Pay close attention to clauses related to payment, timelines, termination, exclusivity, etc. The clauses you want to look out for will depend on the goals you want to achieve. Ensure that the contract aligns with your business objectives and seek legal advice if you need it to ensure that your interests are protected.
